《中国（上海）自由贸易试验区临港新片区促进法律服务业发展若干政策》 Several Policies for the Promotion and the Developmentof Legal Service Industry in Lingang New Area of China(Shanghai)Pilot Free Trade Zone 为促进中国（上海）自由贸易试验区临港新片区（以下简称“临港新片区”）集聚境内外知名法律服务机构和高端法律服务人才，完善临港新片区商事纠纷“诉讼、调解、仲裁”一站式解决功能，推进临港新片区国际法律服务中心建设，着力营造一流的国际化、法治化营商环境，根据《中国(上海)自由贸易试验区临港新片区总体方案》(国发﹝2019﹞15号）、《中国(上海)自由贸易试验区临港新片区管理办法》(沪府令19号)和《中共上海市委上海市人民政府关于促进中国(上海)自由贸易试验区临港新片区高质量发展实施特殊支持政策的若干意见》(沪委发﹝2019﹞20号）等文件精神，结合临港新片区实际，特制定本政策。 In order to accelerate the assemblage of domestically and internationally recognized legal service institutions and high-end legal service talents in Lingang New Area of China(Shanghai)Pilot Free Trade Zone(hereinafter referred to as"Lingang New Area");to perfect the"litigation,mediation,arbitration"one-stop commercial dispute solution mechanism in Lingang New Area;to promote the establishment of the international legal service centre in Lingang New Area,and to strive to create a first-class business environment that is internationalized and with the rule of law,according to the"General Plan for Lingang New Area of China(Shanghai)Pilot Free Trade Zone"(NDRC[2019]No.15),"Administrative Measures for Lingang New Area of China(Shanghai)PilotFree Trade Zone"(Shanghai Government Order No.19)and"the Several Opinions of the Communist Party of China Shanghai Municipal Committee and the Shanghai Municipal People's Government on Promoting the High-Quality Development of Lingang New Area of China(Shanghai)Pilot Free Trade Zone and Implementing Special Support Policies"(No.20[2019],Shanghai CPC Municipal Committee)and other documents,and in combination with the state of affairs of Lingang New Area,hereby promulgate these policies. 一、支持范围 I.Scope of support 本政策适用于注册登记地、实际经营地和财税户管地在临港新片区的境内外法律服务机构及有关组织。 These policies are applicable to domestic or international legal service institutions whose place of registration,actual place of business,and place of fiscal and tax account management is in Lingang New Area. （一）境内外仲裁机构、调解机构等争议解决机构在临港新片区设立的业务机构。 (1)Business agencies of domestic or international dispute resolution institutions such as arbitration institutions,mediation institutions etc…in Lingang New Area. （二）律师事务所（含国内律师事务所分所、外国及港澳律师事务所代表机构、联营律师事务所）、公证、司法鉴定、域外法律查明等法律服务组织或机构。 (2)Law firms(including the branches of domestic law firms;representative offices of foreign,Hong Kong and Macao law firms;and joint operation firms),legal service organizations or institutions such as notary public,judicial appraisal,and ascertainment of non-mainland Chinese law. （三）其他有利于临港新片区法律服务业国际化或加强国际法律合作交流的组织或机构。 (3)Other organizations or institutions conducive to the internationalization of the legal service industry or to the strengthening of the international legal cooperation and exchanges in Lingang New Area. 二、支持内容 II.Content of support （一）机构落户奖励 (1)Awards for setting up institutions 1.鼓励境内外知名法律服务机构在临港新片区设立总部或业务机构；鼓励相关机构或个人在临港新片区设立各类法律服务机构。 1.Domestically and internationally recognized legalservice institutions are encouraged to set up their headquarters or business agencies in Lingang New Area;relevant institutions or individuals are encouraged to set up various kinds of legal service institutions in Lingang New Area. （1）对在临港新片区设立总部的律师事务所，经司法部或中华全国律师协会评定为全国优秀律师事务所，或上一年度入选世界著名法律评级机构榜单的，可申请一次性专项奖励100万元。前来临港新片区设立分所或代表机构的，可申请一次性专项奖励50万元。 (1)For alaw firm setting up its headquarter in Lingang New Area,where such a law firmis rated a nationally outstanding law firm by the Ministry of Justice or China Lawyers Association,or is listed in the world’s leading legal ratingagency last year,may apply for a one-off special award of 1 million CNY;where such a law firm setting up a branch or representative offices in Lingang New Area,it may apply for a one-time special award of 500,000 CNY. （2）对在临港新片区设立总部的律师事务所，经省级司法行政部门或律师协会评定为省级优秀律师事务所的，可申请一次性专项奖励50万元。前来临港新片区设立分所的，可申请一次性专项奖励20万元。 (2)For a law firm setting up its headquarter in Lingang New Area,where such a law firm is rated a provincial-level outstanding law firm by the provincial-level judicial administrative department or a provincial bar association,may apply for a one-off special award of 500,000 CNY;where such a law firm setting up a branch in Lingang New Area,it may apply for a one-time special award of200,000 CNY. （3）对在临港新片区设立中外或港澳联营律师事务所的，可申请一次性专项奖励100万元。 (3)For a law firm setting up a Chinese-foreign joint operation firm,or a Mainland-Hong Kong,Mainland--Macao joint operation firm in Lingang New Area,it may apply for a one-time special award of 1 million CNY. （4）在临港新片区设立业务机构的国际商事海事仲裁机构、调解机构等争议解决机构，可申请一次性专项奖励100万元。 (4)For an international commercial and/or maritime arbitration institution,mediation institution and other dispute resolution institution setting up a business agency in Lingang New Area,it may apply for a one-time special award of 1 million CNY. （5）在临港新片区设立公证、司法鉴定、域外法律查明等其他法律服务机构，可申请一次性专项奖励20万元。 (5)For other legal service institutions,such as notary public,judicial appraisal,and ascertainment of non-mainland Chinese law setting up in Lingang New Area,they may apply for a one-time special reward of 200,000 CNY. （6）经中央国家机关（含全国人大常委会、最高人民法院、最高人民检察院、司法部等）批准同意在临港新片区设立、有利于推动临港新片区法律服务业国际化或加强国际法律合作交流的组织或机构，给予100万元一次性专项奖励。 (6)For an organization or institution conducive to the internationalization of the legal service industry or to the strengthening of the international legal cooperation and exchanges in Lingang New Area,with the approval of its settingup by the central state authority(including the Standing Committee of the National People's Congress,the Supreme People's Court,the Supreme People's Procuratorate,the Ministry of Justice,etc.),to which a one-time special award of 1 million CNY will be granted. （7）落户临港新片区，对临港新片区法律服务业国际化具有特别重大意义的组织或机构，可以按照“一事一议”原则，给予专项奖励。 (7)For an organization or institution settling in Lingang New Area which is of great significance to the internationalization of the legal service industry in Lingang New Area,to which a one-time special award may be granted on a“case by case”basis. （二）办公用房扶持 (2)Support of premises 2.对在临港新片区租赁自用办公用房的法律服务机构，根据实际租赁办公面积和用途，经测量核实确认后，由临港新片区管委会按照1.00元/平/天的补贴标准，拨付至楼宇（园区）运营主体，由运营主体视具体情况统筹分配。对在临港新片区租赁自用办公用房的非营利性法律服务机构，根据实际租赁办公面积，按年租金最高100%的比例给予补贴。 2.For the legal service institutions renting business premises for self-use in Lingang New Area,a subsidy at the standard of 1.00CNY per square meter per day will be granted to the operator of the building(park)for it to distribute according to the specific situations by Lingang New Area Management Committee in accordance with the actual area and use of the leased premise upon verification,measurement and confirmation.For non-profit legal service institutions renting office premises for self-use in Lingang New Area,a subsidy will be granted according to the actual leased office area at a rate of up to 100%of the annual rent. 3.对在临港新片区建设法律服务集聚区的开发主体，按装修设计和年租金最高100%的比例给予补贴，并可给予一定运营补贴。 3.Subsidies will be granted to the principal organ for the development of the legal service zone in Lingang New Area according to a ratio up to 100%of the decoration and design,as well as its annual rent,and certain operation subsidies may be granted as well. （三）人才保障与便利 (3)Social security and conveniences for the talent 4.人才生活保障和便利。按照临港新片区相关人才引进与保障政策，法律服务机构中的法律人才享受专项奖励等人才奖励，人才公寓、公租房等安居保障，以及子女入学、医疗保障等便利条件。 4.Living security and conveniences for the talent.In accordance with the relevant talent attraction and guarantee policies of Lingang New Area,legal talents in legal service institutions shall enjoy special awards and other talent awards,apartment for the talent,public rental housing and other living security,as well as other conveniences for their children's enrolment,medical security etc... 5.直接贡献奖励。对符合本政策规定的法律服务机构中的法律人才，可以申请认定为高端人才，按其上一年度对临港新片区地方经济发展贡献给予一定奖励。 5.Awards for direct contribution.Legal talents in legal service institutions meeting the requirements of these policies mayapply for their recognition as high-end talents,and certain rewards may be granted according to their contribution to the local economic development of Lingang New Area in the previous year. 6.人才出入境及停居留便利。在临港新片区法律服务机构工作的外籍法律人才享受电子口岸签证便利；对拟长期工作的，进一步放宽其年龄、学历和工作经历等限制，可一次性给予2年及以上的工作许可；符合认定标准的，可直接申请在华永久居留，并缩短审批时限。在临港新片区法律服务机构工作的入外籍留学回国人员，可直接办理长期（最长有效期10年）海外人才居住证B证，免办工作许可。 6.Conveniences in the exit-entry and residence permit for of immigrant and residence.Foreign legal talents working in legal service institutions in Lingang New Area shall enjoy the convenience of electronic portvisas;for those who plan to work long term,further relaxes in the restrictions on the age,education and work experience,and a one-time work permit for 2 years or more could be granted to them;where the criteria are met,they may directly apply for their permanent residence in China and the shortening of the time period for the examination and approval of such.People who have studied abroad and acquired foreign citizenship,yet working in legal service institutions in Lingang New Area,may directly apply for a long-term(maximum period of validity for 10 years)overseas talent residence permit type B certificate,exempting from a work permit. （四）高端法律服务奖励 (4)Awards for high-end legal service 7.经济贡献奖励。对落户临港新片区的法律服务机构，按其上一年度对临港新片区地方经济发展贡献给予一定奖励。对为临港新片区提供实质帮助、重要信息、主导推进具有重大影响力和贡献度的招商引资等项目的法律服务机构，可以按照“一事一议”原则，给予专项奖励。 7.Awards for economic contribution.The legal service institutions settled in Lingang New Area willbe granted certain awards according to their contribution to local economic development of Lingang New Area in the previous year.For legal service institutions provided substantial assistance,important information,and lead the promotion of investment projects with significant influence and contribution to Lingang New Area can be granted special award on a"case by case basis". 8.专业服务奖励。为临港新片区各级管理机构、企事业单位及海外企业的重大政府/商事谈判、诉讼、仲裁、调解、主导国际行业标准制定并发布、参与国际条约制定或修改等涉外法律服务事项作出突出贡献，挽回或获得重大权益，产生重大国内外影响的法律服务机构，经临港新片区管委会组织外部评议后，给予最高100万元专项奖励。其中，在最高人民法院、国际仲裁机构、G20成员国家、一带一路沿线国家司法机关或仲裁机构取得胜诉裁判，或被司法部等国务院相关部门或全国性行业协会向全国表彰推广的，每个项目一次性给予最高10万元的奖励，每个法律服务机构每年度给予最高50万元的奖励。 8.Awards for professional service.The legal service institutions made outstanding contributions,restored or acquired significant rights and interests,and gave rise to significant domestic and international influences in their foreign-related legal service affairs such as major governmental/commercial negotiations,litigation,arbitration,mediation,taking the lead in the formulation and publication ofinternational industry standard,participation in the formulation or modification of international treaty,etc.,a special award of up to 1 million CNY will be granted to them upon the external review and approval organized by the Management Committee of Lingang New Area.Among the above,where the case is won at Supreme People’s Court,international arbitration institution,the judicial organs or arbitration institutions of the G20 countries and the countries along the Belt and Road;or being promoted to the whole country by the Ministry of Justice and other relevant State Council departments ornational industry associations,a one-time award of up to 100,000 CNY is granted to each project,and an award of up to a maximum of 500,000 CNY is granted toeach legal service institution annually. 9.举办活动奖励。对在临港新片区召开与法治营商环境、国际化法律服务等主题相关的具有国内外重要影响力的会议、论坛或培训的，经临港新片区管委会会同有关行政主管部门事先审核同意，可按照实际支出费用最高40%的标准，给予每场活动最高5万元、每个法律服务机构每年度最高20万元的补贴。 9.Awards for organizing events.For meetings,forums or trainings with important domestic and international influences related to the subjects of business environment under the rule of law,internationalized legal service,etc.in Lingang New Area,a subsidy of up to 50,000 CNY per activity and a maximum of 200,000 CNY per year for each legal service institution can be granted according to the standard of up to 40%of the actual expenditure on the prior consent by,and upon the review of Lingang New Area Management Committee jointly with other relevant administrative authorities in advance. （五）其他扶持措施 (5)Other supporting measures 10.支持临港新片区内银行在“展业三原则”的基础上，凭收付款指令直接为法律服务机构办理跨境贸易人民币结算业务，直接办理法律服务业务下的跨境人民币收入在境内支付使用。 10.Banks in Lingang New Area are supported to directly settle the cross-border RMB business for legal service institutions on the basis of the“know you business,know your client,and due diligence”,and directly handle cross-border RMB income for payment within Mainland China for legal service business. 11.探索针对法律服务机构的特殊税收优惠政策，实施“无税无票不申报”制度，对当期无应税收入且未做票种核定的法律服务机构，免于办理部分税种的申报纳税。对在临港新片区工作的境外法律服务人才个人所得税税负差额部分给予补贴。 11.Explore special tax preferential policies for legal service institutions,implement a"no tax,no invoice,no declaration"mechanism,and legal service institutions without taxable income and without invoice approval in the current tax period are exempted from tax declarations for certain tax types.Subsidies will be granted to make up the differences in the individual income tax borne by overseas legal service personnel working in Lingang New Area. 三、附则 3.Supplementary provisions （一）本政策条款若与临港新片区管委会制定的其他政策有重复交叉的，按照从高不重复原则予以落实。 (1)Where the provisions of these policies overlap with other policies formulated by Lingang New Area Management Committee,they shall be implemented in accordance with the principles of lex superior and non-repetition. （二）扶持对象应承诺自享受扶持政策起，5年内不迁离临港新片区，否则应返还已领取或享受的相关奖励与补贴。扶持对象享受的各类奖励与补贴总和原则上不得超过扶持期内对临港新片区的地方经济发展贡献额。 (2)The supported object should promise not to relocate out of Lingang New Area within 5 years from the time that they enjoy from the supporting policies,otherwise the relevant awards and subsidies they have been received or enjoyed by them should be returned.In principle,the sum of all kinds of awards and subsidies enjoyed by the supported objects shall not exceed their contribution to the local economic development of Lingang New Area during the period of support. （三）扶持对象如通过弄虚作假等不正当手段骗取扶持资金，一经查实，将立即取消一切扶持资格并追缴资金。情节严重的，将依法追究法律责任。失信行为将根据有关规定纳入公共信用信息数据平台。 (3)Where the supported object defrauds the supporting funds through fraudulent or other improper means,once verified,all qualifications for the support will be annulled immediately and the funds be recovered.In serious circumstances,the liability of the offender will be pursued.The misconduct will be recorded in the public credit information data platform according to relevant regulations. （四）本政策由中国（上海）自由贸易试验区临港新片区管理委员会负责解释。 (4)The Management Committee of Lingang New Area of China(Shanghai)Pilot Free Trade Zone is responsible for the interpretation of thesepolicies. （五）本政策自2020年1月1日起实施，有效期至2022年12月31日。 (5)These policies are to be implemented from 1 January 2020,and be valid until 31 December 2022. |
